EFDI Paper: ICS Regulatory Framework in the EU

Dear Colleagues,

We are really pleased to share with you the paper approved by the Investor Compensation Working Group (ICSWG) about the Investor Compensation Scheme (ICS) Regulatory Framework in the EU. 

This is the first paper of a three-part package of papers being prepared by the ICSWG which will eventually tackle, from a practitioner perspective, the 2010 Commission Proposal to recast the ICS Directive (Paper 2) and Potential Involvement Improvements (again from a practitioner perspective) to the ICS Directive (Paper 3)

The objective of this paper 1 is to summarise at a very high level the relevant EU regulatory pieces that define or affect the way EU ICS are regulated at EU level and discharge their function to cover entities, activities, clients and products.  

This paper also identifies the EU legislative institutions and EU supervisory body in the ICS sphere, and certain activities, reports and proposals prepared by those entities including powers available to them.
